TERMS OF SERVICE
1. Scope of Work
All services provided are governed exclusively by the written estimate, proposal, drawings, and any approved change orders. No verbal agreements, representations, or modifications shall be binding unless confirmed in writing and signed by both parties. Grand Mesa Cabinets & Countertops provides fabrication and installation of cabinetry, laminate, solid surface, and wood countertops and related components as described in the approved proposal.
2. Quotes & Pricing
All estimates are valid for thirty (30) days unless otherwise stated. Pricing is subject to change due to fluctuations in material costs, supplier pricing, or scope modifications. Final pricing is based on approved drawings, templates, and confirmed material selections.
3. Deposits & Payment Terms
A non-refundable deposit of fifty percent (50%) of the total contract price is required to secure scheduling and initiate material ordering. The remaining balance is due prior to installation unless otherwise agreed in writing. Failure to remit final payment may result in delayed installation. Grand Mesa Cabinets & Countertops reserves the right to assess late fees on unpaid balances and to pursue all available remedies, including lien rights as permitted under applicable law.
4. Templating & Site Readiness
Site conditions must be fully prepared prior to templating. Cabinets must be permanently installed, secured, and level. Grand Mesa Cabinets & Countertops is not responsible for verifying structural integrity of existing cabinetry. If the site is not ready at the scheduled time, additional trip and/or re-templating fees may apply. Delays caused by other trades, structural issues, or customer scheduling do not constitute grounds for refund or cancellation.
5. Fabrication & Installation
Fabrication will begin following template approval, material confirmation, AND deposit of 65% of total job price. Due to the nature of laminate, solid surface, and wood materials, minor color variations, seams, and manufacturing tolerances are normal and acceptable. The customer is responsible for ensuring clear access during installation. Plumbing reconnection and electrical work are not included unless specifically contracted.
6. Change Orders
Any changes to scope, material, layout, or specifications must be documented and approved in writing. Changes requested after fabrication has begun may incur additional costs and extend project timelines.
7. Warranty
Grand Mesa Cabinets & Countertops provides a limited one (1) year workmanship warranty covering defects in fabrication and installation under normal residential use. This warranty does not cover damage due to misuse, abuse, excessive heat, improper support, structural movement, or modifications performed by others. Manufacturer warranties for materials apply separately where available.
8. Limitation of Liability
Grand Mesa Cabinets & Countertops liability shall be limited to the total contract value, and shall not be liable for indirect, incidental, or consequential damages, including but not limited to lost profits, project delays, or third-party costs.
9. Cancellation
Orders canceled after material has been ordered or fabrication has begun are subject to forfeiture of deposit and reimbursement for incurred costs.
10. Governing Law & Dispute Resolution
This agreement shall be governed by the laws of the State of Colorado. Any disputes shall be resolved in the appropriate courts within the State of Colorado. The prevailing party in any legal action shall be entitled to recover reasonable attorney’s fees and costs.
